1. Acceptance of Terms

By downloading, accessing, or using the Tally application ("Service"), you agree to be bound by these Terms, which form the End User License Agreement ("EULA") between you and Tally. If you do not agree, do not use the Service.

Relationship with Apple.This EULA is entered into between you and Tally only, and not with Apple Inc. ("Apple"). Tally, not Apple, is solely responsible for the Service and its content. Apple has no obligation whatsoever to provide any maintenance or support services with respect to the Service.

Relationship with Google.For Tally obtained through Google Play, this EULA is entered into between you and Tally only, and not with Google LLC ("Google"). Tally, not Google, is solely responsible for the Service and its content.

2. Nature of Services

Tally is a sports score tracking application designed for Apple Watch and Wear OS, with an iPhone and Android companion app for match history, live scores, widgets, and sharing.

  • Score Tracking Only: Tally provides score tracking functionality. It does not provide official scorekeeping for sanctioned tournaments or competitions.
  • No Guarantee: While we strive for accuracy, we do not guarantee that score calculations will be error-free in all scenarios.
  • AI-Generated Insights (Tally Pro):Tally Pro features — including the Coach's Report, post-match narrative recaps, pattern detection, and the Ask Coach chat — produce AI-generated content for informational and entertainment purposes only. They are not professional coaching, medical, or training advice, and may contain inaccuracies. Use your own judgment when applying any AI suggestions to your play, training, or health decisions.

3. User Eligibility

There are no age restrictions for using Tally. The app does not require account creation or collect personal information. Tally is free to download and use for core score tracking. An optional add-on subscription (Tally Pro) is available for advanced AI analysis features (see Section 4).

4. Purchase and Payment

Tally uses a free download + optional subscription model. You can use the core score-tracking experience for free, forever — Tally Pro is entirely optional.

  • Free Download: Tally is free to download from the Apple App Store and Google Play. This unlocks core score tracking, your recent match history, health sync, spoken score-calls, and every free feature at no cost.
  • Tally Pro (Optional Subscription):Tally Pro is an optional auto-renewing subscription that adds AI match analysis, Coach's Report, full match history, cross-match pattern detection, and heart-rate correlation. Pricing is $3.99/month or $29.99/year (a 37% annual discount). As a launch promotion, Tally Pro is free for everyone through June 30, 2026. Tally Pro is not required to use the app.
  • Auto-Renewal:Tally Pro subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before renewal. You can manage or cancel your subscription at any time in your App Store account (Settings > Apple ID > Subscriptions) on iPhone, or in Google Play subscriptions on Android.
  • Payment: All subscription payments are processed through your Apple App Store or Google Play account. We never see or store your payment details.
  • Refunds: Refund requests are handled by Apple or Google in accordance with the App Store or Google Play refund policies.

5. User Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble the app or its components.
  • Use the app for any unlawful purpose.
  • Attempt to interfere with the app's functionality or security.

6. Intellectual Property & License Grant

Tally, its design, branding, and all related intellectual property are the exclusive property of the Tally team. Subject to your compliance with these Terms, Tally grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

  • Scope of License (App Store Apps):For Tally obtained through the Apple App Store, your license is further limited to use on any Apple-branded device you own or control, as permitted by the Usage Rules set forth in Apple's App Store Terms of Service. You may also access the Service on other Apple devices associated with your Apple ID via Family Sharing or volume purchasing, where supported by Apple.
  • Scope of License (Google Play Apps): For Tally obtained through Google Play, your license to use the Service is governed by the Google Play Terms of Service and is limited to devices you own or control.
  • Restrictions: You may not copy (except as permitted by this license), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Service or any part thereof.

7. Consent to Use of Data

You agree that Tally may collect and use technical data and related information — including but not limited to device model, OS version, and crash diagnostics — to facilitate software updates, product support, and other services to you related to the Service. Tally's handling of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. External Services

The Service may integrate with external services, including Apple HealthKit, Apple Fitness, Google Health Connect, and the Apple App Store or Google Play for in-app purchases and subscriptions ("External Services"). You agree to use External Services at your sole risk. Tally is not responsible for examining or evaluating the content or accuracy of any third-party External Services and shall not be liable for any External Services.

9. Disclaimers and Limitation of Liability

  • As-Is Basis:The Service is provided "as is" and "as available," with all faults and without warranty of any kind. Tally hereby disclaims all warranties and conditions with respect to the Service, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights.
  • Apple Warranty:In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Tally's sole responsibility.
  • Score Accuracy: While we employ automated scoring rules (side-outs, server tracking, win-by-2), we are not liable for scoring errors or discrepancies.
  • Liability Cap:To the fullest extent permitted by law, in no event shall Tally be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever. Tally's total liability to you for all damages shall not exceed the amount you actually paid for the Service.

10. Termination

This EULA is effective until terminated by you or Tally. Your rights under this EULA will terminate automatically without notice from Tally if you fail to comply with any term(s) of this EULA. Upon termination, you shall cease all use of the Service and destroy all copies, full or partial, of the Service.

11. Export Compliance

You may not use or otherwise export or re-export the Service except as authorized by United States law and the laws of the jurisdiction in which the Service was obtained. In particular, but without limitation, the Service may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce's Denied Persons List or Entity List. By using the Service, you represent and warrant that you are not located in any such country or on any such list.

12. U.S. Government End Users

The Service and related documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with those provisions, the Service is licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights granted to all other end users under these Terms.

13. Governing Law

These Terms and any dispute arising out of or related to them or the Service shall be governed by the laws of the State of California, excluding its conflicts-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14. Third-Party Beneficiary

You and Tally acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Contact & Claims

Address any questions, complaints, or claims regarding the Service to: support@tally.fast. Tally is solely responsible for addressing any claims you or any third party may have relating to the Service, including but not limited to product liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.

16. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated through app updates or on this page.
